Study on Compensation System for Ecological Environment Damage in Underground Space Development

The acceleration of the scale and process of underground space development has caused a series of legal problems. The ecological environment damage in underground space development is one. The compensation system for ecological environment damage of underground space is a complex issue, involving multiple cross fields of public law and private law, substantive law and procedural law. Through the dual perspective of public and private law to examine the current domestic legislation, on the basis of the comparison of the relevant systems outside the country, this paper puts forward countermeasures and suggestions to improve the ecological environment damage compensation system in the development of underground space in China from the aspects of citizens' substantive rights, liability risk burden, specialized evaluation mechanism and relevant litigation rules.
