Study on the Application Status and Standardized Complementation of the Daily Penalty Consummate in China

This paper studied the formation and complementation of the Daily Penalty Consummate in China. The applicable range of the Daily Penalty Consummate is narrow,and there are many disputes of the consummate in view of its theory and practice,which has led to its inefficient application. The local eco-environment bureaus should give full play to its strengths and try to avoid its weaknesses to normatively apply the consummate within the existing legal framework. The Daily Penalty Consummate should be effectively complemented in order to fight against enterprises that illegally discharge pollutants continually. The Daily Penalty Consummate would effectively guide enterprises to actively fulfill obligations of pollution treatment to jointly build the beautiful China.
